1 consequential vacancy arising from the appointment of a Judge of the High Court to the rank of Justice of Appeal with immediate effect from the date of appointment, if approved by the Secretary of State.

3. WHEN REQUIRED:

Upon the promotion of Mr. Justice Mortimer to the Court of Appeal if approved.

ENTRY REQUIREMENTS:

By air. The officer will be required to sign passage agreement undertaking with the Commissioner, London to refund the cost of passages to Hong Kong in the event of his failing to serve in Hong Kong for a period of

years:

To hear and determine cases, civil and criminal in the High Court; and

to sit as an additional judge of the Court of Appeal if so requested by the Chief Justice, in which case he shall have all the jurisdiction, powers and privileges of a judge of the Court of Appeal.

As stipulated in Section 9 of the Supreme Court Ordinance, Chapter 4 of the Laws of Hong Kong (an extract is attached).
