2. Registrars etc and other judicial officers: We assume that Mrs Krun raises this point because Judges get a separate mention in the definition of

of "specified officer", but the rest of the judiciary and their staff do not. The reason why the Judges get a separate mention is because, originally, judges and magistrates formed a separate list as Her Majesty's Overseas Judiciary (HMOJ) though no difference was made to between those on that the list and the members of HMOCS so far as the benefits provided by the White Paper - Colonial 306 - and its successors were concerned. This did not apply to the Registrars or staff of the judiciary and they were enrolled, if otherwise qualified, as members of HMOCS.

3. Paragraph 2(1)(a)(ii) is in its present form because Hong Kong Judges queried whether they should be enrolled in HMOCS. They were apparently told by HMG that they would be listed as members of HMOJ, but treated as if they were members of HMOCS. Having said that we do recognise that the definition of "specified officer" may not be sufficiently comprehensive for the Judges or whether we have adequately covered magistrates. We shall therefore rectify the position by amending sub-paragraph (i) by adding, at the end after "Service", "or Her Majesty's Overseas Judiciary" and by amending sub-paragraph (ii) by inserting in line 6 after "Secretary of State", the words "or magistrate".
