Thank you for sending me a copy of Alan McDonald's comments (28th June) on the revised draft attached to my fav of 15th June. I have the following observations:
MAIN SCHEME
Paragraph 1: Agreed.
Paragraph 2(b)(1): The draft has the same effect as McDonald's text, but I would have no objection to drawing on his words. Replace (i) by:
"(i) the pension first awarded to an officer with effect from the date of his retirement or, if the pension is deferred, the amount that would have been awarded had the pension commenced on the date of his retirement;".
Paragraph 4(2): Are not pensions granted at an annual rate ?
In which case "one twelfth " should stay.
Paragraph 7: We await comments from Hong Kong.
Paragraph 10: I do not think the order of recoupment affects the drafting.
