A SCHEME FOR THE PROVISION OF SUPPLEMENTS TO MEMBERS OF HMOCS AND THEIR DEPENDANTS IN RESPECT OF CERTAIN RENEFITS PAYABLE UNDER THE PENSIONS LAWS OF HONG KONG

COMMENCEMENT OF SCHEME

1. This Scheme will come into operation on the date in 1994 on which an Order under section 59 of the United Kingdom Social Security Pensions Act 1975 takes effect [or, if no such Order takes effect in that year, the 8th April 1994].

DEFINITIONS AND CONSTRUCTION

2. In this Scheme (including the Schedule):

(a) a member of HMOCS means-

(i) a person who was a member of Her Majesty's Overseas Civil Service during his service, or a part of his service, in Hong Kong;

(ii) a judge in Hong Kong (that is to say a judge of the Supreme Court or any court to which appeals lie from the Supreme Court, a judge of the District Court, and a judge of any other court in Hong Kong designated by the Secretary of State) who, during his service in Hong Kong, was informed in writing by or on behalf of the Secretary of State that he would be treated as a member of Her Majesty's

Overseas Civil Service;

(b) "basic pension" and "basic Hong Kong pension" mean:

(i) the pension first awarded to an officer with effect from the date of his retirement or, if the pension is deferred, the amount that would have been awarded had the pension
