with the relevant Acts and Orders in order to calculate the officer's notional pension up to the time of his death and in order to calculate the dependant's notional pension from the date of the officer' death or, if the officer died before 8th April 1991 and the calculation for his notional pension was updated to 1st January 1992 under Heads A, B or E, from the 8th April 1991. Incidently, we will need to explain in any material we produce when introducing the Scheme in Hong Kong the relationship of the 8th April 1991, as the start date for any Orders, to the 1st January 1992. Alternatively could we use the same date, presumably the 8th April 1991, for both the present purposes?

The definition of "commencement date" is new and is included to shorten the drafting in paragraph (e). Please also note the changes in paragraph (c) and that I have reverted to "basic pension" instead of "root pension" in paragraph (d).

Part III G(d): In this paragraph and in Part III I(d), I have replaced the passage "as if the sum were a pension begining on..." by "as if the sum were payable on.." as this would seem to be more in accord with the relevant

legislation.

Part III H:

Is this agreed ?

Note that I have opted for one of the alternatives in the last line.

Part III T(h): The passage formerly in square brackets, which raised a question on the Hong Kong law, has been deleted after discussion with Alan McDonald.
