HONG KONG: ARRANGEMENTS FOR HER MAJESTY'S OVERSEAS CIVIL
SERVICE (HMOCS)
1.
The Minister requested a note on the legislation required
to implement the arrangements for HMOCS.
2.
Primary legislation will be required to obtain
Parliament's authority to enable payments to be made under the
proposed compensation scheme and the sterling pension
safeguard. We anticipate that this will be a short piece of legislation. The schemes themselves will be made by Order in
Council. Whether they will need to be laid before Parliament
will depend on legal advice on whether a negative or affirmative resolution procedure should be adopted.
