entitled officer, and the dependents and personal representatives of an entitled officer shall provide the Secretary of State with such information as the latter may reasonably require to enable him to ascertain and verify any entitlement to the payment of compensation under this Scheme, the amount of such compensation and the

circumstances in which any part of compensation or interest is payable.

SECRETARY OF STATE TO DECIDE ALL QUESTIONS OF INTERPRETATION OF THE SCHEME

20. Any question relating to the interpretation of this Scheme, including any question as to who is a member of HMOCS or otherwise an entitled officer and what shall be deemed to be the salary point and grade as at 1st January 1992 of the salary point and grade of any officer at any later date, shall be determined by the Secretary of State.

[GENERAL

21. (1) It is proposed that a Bill will be introduced into Parliament to provide:

(a) statutory authority for the Scheme and for the payment of compensation and interest to be made from monies provided by Parliament;

(b) that no United Kingdom tax on income shall be chargeable on the compensation [or interest];

(c) for incidental matters such as the recovery of

overpayments.

(2) The Government of Hong Kong has undertaken that the Scheme will be approved as a compensation scheme for the purposes of the relevant pensions laws. 1
