by HKG, it is appropriate to set a closing date for submission of applications from officers in the service of Hong Kong for membership of HMOCS. The closing date will be 28 February 1993. ALL officers, whether or not they have been informed of the result of their application to HKG to transfer to pensionable terms, should apply before that date.

The deadline in paragraph 3 above does not apply to members of the Hong Kong Judiciary, for whom separate arrangements apply as set out in the statement on behalf of the Secretary of State on Membership of HMOCS circulated under cover of the Registrar, Supreme Court's Memorandum on Transfer to the Permanent and Pensionable Establishment and Membership of HMOCS dated 12 August
1992.
Deadline for bought back service counting towards any compensation for HMOCS officers

HKG permits overseas officers appointed on agreement terms whose applications to transfer to pensionable terms were approved after 26 July 1991, to have 12 months after the date they became pensionable in which to buy back or
to buy back or commence buying back pensionable service. Overseas officers appointed on agreement terms who transferred to pensionable terms before 26 July 1991 may buy back pensionable service at any time up to retirement. Judicial officers, on the permanent establishment, who were aged 53 or above on 30 August 1991, were permitted to retain the right to refund contract gratuities by means of one lump sum payment not later than 10 days before they commenced pre-retirement leave.

HMG has decided that:
(i) Officers whose applications for transfer to pensionable terms have been approved must commence buying back service before or 30 April 1993 if they wish bought back service to count as pensionable service under any HMG compensation scheme for HMOCS officers.
(ii) Judicial officers referred to in paragraph 5 above will be required to sign an irrevocable undertaking before or April 1993, to buy back such contract service as they wish to convert to pensionable service to count as pensionable service under any HMG compensation scheme for HMOCS officers.
