rescribed in the Scheme] -
(a) the [average] rate of exchange of the HK$ against sterling exceeds HK$ XX to the £; and
(b) the sum of
(i) the amount paid to the pensioner in the currency of Hong Kong in respect of his notional Hong Kong pension for that [year] [period] (including any increases made to such pension under the law of Hong Kong since the grant of such pension) when converted into sterling during that
[year] [period) and
(ii) the amount paid by way of supplement (SPOS) under regulations made under the Pensions (Increase) Act 1971, to the pensioner in respect of his [total] [notional] Hong Kong pension,
is less than the pensioner's UKPB as increased by the increase in the UK retail price index up to the end of that [year][period],
the Secretary of State will pay to the pensioner a supplement equal to the sterling equivalent of the
difference between the average during that [year] [period] of the exchange rate and the rate of HK$ XX = £1 multiplied by a figure equal to the UKPB.
(2) If the amount of a pension granted and payable under the law of Hong Kong is greater than the notional Hong Kong pension, then, in making any calculation under this section, the amount of any increase made under the law of Hong Kong since the grant of the pension [and the amount of any supplement made under SPOS 1 to be attributed to the notional Hong Kong pension shall be in the like proportion as the notional Hong Kong pension bears to the total pension granted under the law of Hong Kong.
5. Registration of UKPB
(1) In order to qualify for the payment of supplements under this Scheme, a pensioner shall provide the Secretarys of State:
