beginning in April 1992; this would produce a "notional retirement salary", based on the movement of the United Kingdom Retail Price Index from 1992 to the appointed day;

(c) multiply the notional retirement salary by the appropriate factor taken from the relevant Table, which will produce a in HK dollars;

(d) convert the sum arrived at in sub-paragraph (c) into sterling using the average rate of exchange between the HK dollar and the £ sterling during 1991 (ie £1 = HK$13,760-9); the resulting sum in sterling or £120,000, whichever is the less, is the compensation payable.

(4) In this paragraph, "the appropriate factor" in relation to an entitled officer means the factor obtained from the relevant Table that is appropriate to the age and pensionable service of that officer on the appointed day in completed years [and months or, if it is more favourable to the officer, reckoned in completed years without regard to months].

PAYMENTS OF COMPENSATION

8.(1) A payment of one fifth of the compensation due will be paid to every entitled officer as soon as possible after the appointed day.

(2) Subject to sub-paragraphs (3) and (4) of this paragraph and paragraphs 9, 10 and 11, a further payment of one fifth [sixteen percent] of the compensation due shall be paid to each entitled officer on the first, second, third (and fourth] [, fourth and fifth] anniversaries of the appointed day.

(3) If the balance of compensation outstanding immediately before any anniversary of the appointed day is, without counting any sum payable in respect of interest under sub-paragraph (4), less that [£5,000], the whole of that balance shall be paid on that anniversary.

Any entitled officer who remains on the permanent and pensionable establishment of the Government of the Hong Kong Special Administrative Region on an anniversary of the appointed day when he is entitled to be paid an instalment of compensation under sub-paragraph (2), shall be entitled to be paid interest at the rate of 5 per cent per annum on the balance of the amount outstanding of that compensation immediately before that anniversary.

ENTITLED OFFICERS WHO LEAVE THE SERVICE OF THE SAR IN CERTAIN CIRCUMSTANCES
