members of HMOCS: see my fax of 26th August 1992 to Mr Stone. The present draft is confined to members of HMOCS and their dependants. When the present proposals are put to Ministers, they should be made aware (again) that individuals who would have been catered for in POAS but are not provided for in these arrangements (if there are any) are likely to complain of their omission.

You will need to consider the following points on the draft:

Section 1: Is it correct that payments will only be made (i.e. the safeguard only comes into operation) in respect of a period commencing after 30th June 1997 ?

Section 2(1): (I) Do we exclude "additional pensions" from any calculation ? I have so drafted but you need to consider the point. Additional pensions are identified in section 2(4) so far as they are apparent from the ordinances set out in section 2(2). Hong Kong should be asked if there are any others. I have not classed as an additional pension a pension paid to the dependants of an officer killed on duty even though the depandant may, apparently, also receive a pension under the Widow's and Children's Pensions Ordinance.

(II) Is it correct that we will pay supplements by way of safeguarding pensions wherever the pensioner is resident (e.g. Australia, El Dorado ) ? See also additional note below.

Section 2(2): I have included pensions paid under replaced Ordinances as the present Widow's etc Ordinance was enacted in 1975 and there may, I suppose, still be pensions paid to widows under the Ordinance which it replaced. If any of the existing Ordinances is replaced, however, we would need to consider whether new provision would be required involving an amendment to the Scheme; we cannot anticipate what might be necesary.

Section 3: (I) You may wish to devise some alternative labels. in place of NHKP and UKPB. !-
