UN SANCTIONS AGAINST YUGOSLAVIA
I have seen your teleletter of 8 March about UNSCR 713 and Kevin Orchard's reply of 9 March. I am also writing on the subject because it was agreed some time ago that I should pursue the points raised in your letter of 11 December with European Community Department (External) and Legal Advisers. I have just received a response from Legal Advisers and am now in a position to reply to you.
As explained in Kevin Orchard's teleletter of 9 March, the UK has implemented UNSCR 713 by the use of export licensing powers. In your letter of 11 December you confirmed that Hong Kong is implementing UNSCR 713 by the same means. Therefore you will be glad to know that the view of our Legal Counsellor is that it is acceptable for the UK and Hong Kong to implement UNSCR 713 in this way and that an Order in Council is not necessary.
Perhaps I should also clarify the position on the UK's implementation of the EC Arms Embargo. Twelve Member States (in what is called European Political Cooperation: EPC) took a political decision to implement this by taking the necessary national measures (in the UK's case these are provided by our
