go to court, there is the possibility that the Hong Kong Government may win, in which case there would be no need to consult the Chinese. On the other hand, if the change to the Colonial Regulations suggested by Mr Pannick at paragraph 25 of his opinion were to be adopted, the incompatibility of the present regulations with the Bill of Rights would cease and much of the problem, apart from present practices, would disappear. From a legal point of view this option is preferable. Moreover, the amendment to the Civil Service Regulations would not require implementation by an ordinance in Hong Kong, and with luck the Chinese may not become aware of the change in the Regulations except insofar as it brings about a change in practice and this leaks out.
