ALLEGED MISCONDUCT BY HONG KONG CIVIL SERVANT
1. I attach a copy of some correspondence sent to the Secretary of State by Knight and Ho, solicitors acting on behalf of two Vietnamese asylum seekers, Le Tu Phuong and Dinh Thi Bich Chinh. Messrs Knight and Ho allege that Mr Michael Ho, first secretary at the British Embassy in Hanoi on secondment from the Immigration Department in the Hong Kong Government, is really performing a Hong Kong Immigration Officer investigatory function, as a back-up support operation to the screening of asylum seekers by his
colleagues in Hong Kong's Detention Centres. They claim that his secondment to the British Embassy is just a nominal title of convenience and that he is really a key figure in the Hong Kong Immigration Department's field investigations into Vietnam.

SEAD have drafted a reply to Messrs Knight and Ho and have asked for our comments on the basis that the solicitors are implying misconduct on the part of a Hong Kong civil servant. The draft reply has been cleared by Hong Kong Government legal advisers. Although we are content with the draft reply, I would be grateful if you could let me know whether you have any comments on it.
