But there are substantial differences between the treatment

of overseas and local offices. These differences appear in

the following three areas. In the context of Article 21,

one is focusing on such differences as between overseas

officers who are permanent residents and local officers who

are permanent residents.

(a) Recruitment

On recruitment, he would only be offered overseas

terms. This has been the position since March 1985

for all posts (including the Administrative Service

and the Police) and was the position for many years

before 28th March 1985 for all posts except the

Administrative Service and the Police.

(b) Transfer to

the

permanent

and pensionable

establishment

(i)

Overseas offices recruited after 28th March 1985

could not apply for such transfer,

But there

(ii) Overseas officers recruited before 28th
