CHANGES TO THE PROVISION OF DUTY-RELATED INJURY BENEFITS (ADDITIONAL PENSION) AND DEATH BENEFITS (DEPENDANT PENSION)

dependant/additional pension are brought into with those in the Employees' Compensation
(ECO).
(Note : the award of dependant/additional
pension is at present subject to there being no fault on the part of the officer, i.e. negligence or carelessness. This is more stringent than the eligibility criteria for employees compensation under the ECO where compensation will be paid unless the injury or
death is proved to be attributable to the employees' serious and wilful misconduct.)
Beneficiaries
(a) The Secretary for the Civil Service will have discretion to determine dependent cohabitees of officers as spouses for the purpose of the grant of dependant pensions.
(b)

Conditions of Payment

The current discriminatory provision where a husband's entitlement to a dependant pension is subject to the test of financial dependency is removed.
Payment of dependant pension (duty related death) to the spouse of a deceased officer will continue

the
spouse's
re-marriage.
