Any officer, other than one serving on agreement terms, who wishes to nominate his/her spouse for death gratuity or ex-gratia payment should complete the nomination form at Annex B and submit it to the Secretary for the Civil Service via his Head of Department. The nomination can be revoked at any time by notice in writing to the Secretary for the Civil Service in the prescribed form at Annex

C.

If the officer does not receive the triplicate Copy of the nomination form or revocation of nomination form from his/her department within 1 month as acknowledgment of receipt, he/she should contact his/her department immediately for clarification.

In accordance with the legislation, only a spouse can be nominated as recipient of the death gratuity or ex-gratia payment. An officer should therefore inform the Secretary for the Civil Service immediately if the person nominated ceases to be his/her spouse. If it is discovered that the person nominated is not the legal spouse of the officer at the time of death, the nomination shall be invalid and death gratuity or ex-gratia payment shall be paid to the legal personal representative of the deceased officer as if there had never made any nomination.

In any case where there is no valid nomination, the death gratuity or ex-gratia payment will be paid to the legal personal representative of the deceased officer.
