3rd December 1992.
Dear Sir,
Proposed Prviate Treaty Grant
of the Colvin House Site for the Future British Consulate-General
I refer to your letter of 13th October 1992 concerning the resumption condition, 1 regzel that I have been unable to get back to you earlier but you will appreciate that this condition is fundamental to ali nominal premium grants by private treaty. Indeed it. is considered that any significant variation to the condition would require reference το της Lanā Commission as it is likely to affect the quantum of compensation payable by the future S.A.R. Government in the unlikely event a resumption.
As explained at the meeting on 21st January 1992, the need for the resumption condition arises from Not no premium, the fact that
the fact that no premium will be paid in respect of the land and from the consequential need for the Grantor to shurely
a pepperam! avoid paying the full market value compensation that would
J
become payable under a statutory resumption. It is precisely herause ท premium is payable that there can be no question of basing compensation on "the real market value of the property" as requested by the Foreign and Commonwealth office.

Hlaving regard to your paragraph 4, I am prepared propose the following amendments Lo Special Condition
(a) the deletion of the proviso in subparagraphs (i) and (ii) of S.C. 14(b) as this is entirely superfluous given the circumstances of grant, and
