Utility Services: Clause 22. the last line.
"reasonable" has been inserted in
Supervisory and overhead charges: Clause 41(b). The first line has been amended to link this clause to Special Condition 7(b).
The sub-clause to Clause 42 which we suggested (and which I referred to in my letter of 30 January to Mr Hughes) was not accepted. Building and Lands (and indeed the representative from Constitutional Affairs) suggested that the diplomatic status of the grantee should be addressed in a separate letter of comfort and not in a clause in the PTG. Mr Hughes has since told me that the letter of comfort would not form part of the PTG (see paragraph 2 of my letter of 30 January to Mr Hughes). We are,
as you rightly conclude in your telno 137 of 30 January, just received, dealing with staff in the Lands Administration Office who are guided essentially by standard rules and how these rules have in the past been applied in practice. Diplomatic immunities and protection are not familiar areas although clearly they must have had some experience with the resident Consular Corps here ( at one point during our meeting on 21 January, Mr Hughes mentioned that the United States had accepted a similarly worded PTG to the one we have now been given).
I agreed earlier this week with Mr Hughes that the application for the re-zoning of the site to enable buildings to extend beyond the current Colvin House building ie to cover the whole site if necessary, should now be submitted to the Town Planning Board for consideration at their next meeting on 21 February. am assured that this is a perfectly straightforward matter and Swire Properties have advised us not to delay submission any longer.
The precise terms of the PTG do not need to be agreed before the submission is made to the Town Planning Board. According to Mr Hughes, the re-zoning of the site would have been approved by now if the matter had not be put on hold following receipt of FCO telno 220 of 30 December.

One final point. The Constitutional Affairs Branch representative raised the question of the title of the grantee. We said that we assumed that this would be Her Britannic Majesty's Secretary of State for Foreign and Commonwealth Affairs and that this would not cause any complications when land in Hong Kong is transferred from the Crown to the Special Administrative Region of China on 1 July 1997. Is there a point we ought to be considering further here?
