Russ Jarvis and I had a meeting with Jim Hughes and his colleagues from the Lands Administration Office and Constitutional Affairs Branch on 21 January to discuss the points raised in your telno 17 of 15 January. Alan Paul unfortunately was not free at the time to attend but we were accompanied and helpfully advised by Messrs Holdaway and Moynam of Swire Properties.
We have now heard further from Mr Hughes. A revised Special Conditions paper was enclosed with his letter of 23 January (both are attached). Mr Hughes also telephoned when he received the letter I sent to him yesterday, a copy of which I faxed to
you.
Not all of the amendments we asked for have been accepted verbatim. You will now wish to consider with OED and legal advisers whether the revised Special Conditions draft as it now stands is acceptable. Clause 13 (Cessation or dimunition of user) has been deleted as we asked.
On specific points, the position as of now is as follows:
Possession: Clause 2(a) At the meeting Mr Hughes made the point that it was usual to include a date and suggested that 1 January 1993 be inserted. However, he has now been advised that Colvin House will be required for a JLG meeting in Hong Kong in March 1993 (apparently the accommodation in Kennedy Road will not be You ready for occupation in time for the March 1993 meeting). will wish to consider whether this will give us enough time to
Swire complete the building in the timescale envisaged earlier. Properties here seem to be of the view that this further delay is acceptable.
Possession: Clause 2(b) Your suggested insertion has been accepted. But Lands Office have included "on the plan annexed hereto" to the 2nd line.
