The memo bears a "chop mark" together with the date 7/2/92.

This chop was used, according to the evidence filed on behalf of

the Governor of Hong Kong, by the Confidential Registry of the

Royal Hong Kong Police Force until March 1990.

After that it

was replaced by a different stamp and was left on a side table

in the Confidential Registry and not normally used. According

to the affirmation of the Confidential Assistant who was working

in the Registry on 7th February 1992 it was not used by her on

that date or by anyone else. Each of the Jalil documents bears

an undated stamp of the Crime Wing Police Headquarters of the

Organised and Serious Crime Group of the Royal Hong Kong Police.

These stamps are undated.

On an earlier date, prior to 20th January 1992, the French

Attorney representing Mr. Saniman in the French extradition

proceedings, received a similar package.

It was on 20th February 1992 that Mr. Osman made his

application for leave to apply for judicial review. The relief

which Mr. Osman primarily seeks on that application is an order

of certiorari to quash the decision of the Chief Metropolitan

Magistrate and a declaration that that order is void and of no

effect.

The grounds upon which relief is sought are as follows:

"The Order of the Chief Stipendiary Magistrate ("the

Committal Order") was made in breach of natural justice.

The requesting state, the Government of Hong Kong, had

withheld from both the Applicant and the Court vital and

relevant material, going to the merits and the strength of

the prosecution against the Applicant. The Applicant has

been deprived of the elementary right to be notified of

evidence known to the Hong Kong Government, which would
