Lorrain Osman

My Rt Hon Friend the Home Secretary ordered yesterday the extradition to Hong Kong of Lorrain Esme Osman. In taking

this decision, the Home Secretary read and took into account representations submitted by Mr Osman's legal representatives on his behalf. He was satisfied that there

was a proper basis to order Mr Osman's return to Hong Kong

for trial on the relevant criminal charges. In particular,

he was satisfied that it would not be unjust or oppressive

to return Mr Osman. The Home Secretary concluded that there

were no other grounds for refusing the extradition request.

Unreasonable to detain Osman for so long?

Mr Osman's prolonged detention in the UK is entirely due

to the very extensive use he has made of the appeals

procedure. Seven applications for a writ of habeas corpus

have been heard and rejected by the Divisional Court.

Why not grant bail?

Bail is a matter for the courts. Mr Osman has made four

applications, all of which have been rejected.

Will Osman be subject to unjust treatment after Hong Kong

reverts to China?

My Rt Hon Friend the Home Secretary was satisfied that

the speciality rule undertaking given by the Governor of

Hong Kong, by which Mr Osman may be dealt with following his

return to Hong Kong only in respect of those offences for which his extradition was granted, protected him from any

further action.

What next?

a

Mr Osman's legal counsel has submitted further

application for a writ of habeas corpus. Once this has been

considered by the Divisional Court we hope that Mr Osman's

detention in the UK can be brought to a speedy end.
