Malaysia Finance Ltd. ("BMFL"), a subsidiary of the Bank

Bumiputra Malaysia Berhad ("BBMB") a major Malaysian bank owned

by the Malaysian Government, he conspired with others to cause

unsecured loans to be made to the Carrian Group of Companies

("Carrian") without the knowledge of the Malaysian Government and

the banks which supplied the funds for the loans.

Mr. Osman's contention is that the evidence now available

establishes that BBMB, The Malaysian Central Bank and the

Malaysian Government were fully aware and authorised and/or

consented to such loans, that the loans were controlled by senior

Ministers in the Malaysian Government; that BBMB held security

for loans valued at HK$5.25 billion and that the Hong Kong

Government has been fully aware that this was the situation since

at least 1982. That at the time of the alleged offences, Mr.

Osman never resided in Hong Kong and only travelled there every

four to six weeks, he was never an employee of BMFL or BBMB and

during his entire tenure as Non-Executive Chairman of BMFL, he

ran his own various widespread businesses and was one of the most
