141. On the 4th of September 1990 I worked with Bruno Crozel of Siméon & Associes, formally a clerk to the Judidary. He was very helpful. We set about drafting the supplemental note.

142. I spoke with the Attorney General in Hong Kong and suggested that the political advisors speak to the British Embassy in Paris and the Foreign Office and arrange to send a diplomatic note from the Head of Chancery to the Ministry of Justice emphasising the importance of the case, Hong Kong's keen interest in and its commitment to the extradition. I advised that this note should be communicated to the Ministry of Justice at approximately the same time as the supplemental note. I advised that the supplemental note should take the form of a supplemental request by the Governor executed in the usual way.

1991 to

143. We worked all week until the evening of the 7th of September 1991 to complete the note. The object of the note was to present to the Court a concise summary of the transactions and their criminality and Saniman's role in them. We also wished to identify concisely the new facts and the Court function upon a foreign state extradition.

The supplemental note dealt with:-

(1)

the characterising of facts under French law and the application of

double incrimination;

(ii)

the novelty of the present request for extradition;

(ill)

the novelty of the alleged facts themselves;

(iv)

characterisation of facts under applicable Hong Kong law;

(v)

characterisation of facts under French law;

(vi) application of the terms of the 1876 Treaty;
