the control and direction of those directors of BMFL including Saniman. He then said there was a better way of translating the position. M. Chauvy asked me about the size of the fraud which he thought about US$600 million according to our case statements. I explained that at the end of the day the the Deed per total loss to the bank was in the region of US$1.4 billion. As of Assignments. he advised we should annex those to a new request.

M. Chauvy felt that the offences that we now alleged against Saniman will probably not be considered as being new offences but that the facts relied upon (1.e. all the documents which will be contained in the new request) were certainly new facts. I told M. Chauvy that I had brought with me a summary of facts to be included in the new request. I also advised Chauvy that I wished to include certain documents such as board minutes, resolutions and agreements on which Saniman's signature appeared and that I would send those to him in due course. I gave the summary to Chauvy and asked him if he could read it and let us have his comments in due

course.

M. Chauvy reminded me to enclose a warrant of arrest in the new request. I told him that a new warrant would be issued and enclosed in the request. I also suggested that the offences attached to the warrant could be different from those in the first request. M. Chauvy said this was an excellent idea and would certainly impress the French authorities. M. Chauvy agreed to meet with us again in December to discuss the summary and any

matters arising.

On the 6th of December 1988 we met with M. Chauvy in Paris. As a matter of courtesy I brought M. Chauvy up to date on the Osman proceedings in the Divisional Court.
