Osman had been committed to custody by an English Court pending an order for his return to Hong Kong. He was presently appealing

that Order;

(iii) Hashim Shamsudin had returned to Hong Kong and pleaded guilty to offence relating to Saniman, and been sentenced to 10 years imprisonment.

I told him that Saniman was regarded as having played a similar role in the fraud. I explained that as far as the Hong Kong Government was concerned he was a significant fugitive. I advised M. Monnet that in our view Saniman had misled the French authorities in relation to the time he was in Hong Kong and his role in BMFL. I told him that we would be able to produce evidence to that effect.

Monnet emphasised again that, in relation to false documentation upon which we relied, it was sufficient that it was created under the instruction to

Saniman.

I asked Monnet whether or not the French Government would be prepared to accept witness statements in support of an extradition request. He advised me that certified sworn statements would be sufficient for the purposes of the Chambre d'Accussation. He said the Chambre would not enquire into the validity of the statements or their contents as they were not the final court of trial. That was a matter for the Hong Kong Courts.

I told him that I had a number of statements from important witnesses and related documentation that had been translated into French. He told me that I could deliver them to him that afternoon. He said it would be convenient to meet in March to discuss any matters arising out of the statements and to answer any enquiries that he might have as a consequence.
