1. The telegram you have identified was not (not) one of the
nine disclosed to Osman's solicitors in relation to Osman's fourth habeas corpus application, and there is nothing to suggest that it has fallen into Osman's hands. None of the nine
telegrams which were disclosed (the earliest of which dates from
1985) makes any reference to Ghazali or the conversation in
1983. You may reassure Ghazali accordingly. You should not (not), however, offer to divulge the contents of any telegram to
Ghazali.
2. As you will know, Osman has not yet subpoenaed any witnesses. We understand that Osman wishes to call a number of
senior figures to give evidence. These include: Ghafar, Baba, Razaleigh and Ariffin. Hong Kong's Legal Advisers will be able
to assess how likely it is that Ghazali will be called.
3. If Ghazali is subpoenaed, he should give his own account of any discussions he may have had. If he cannot recall them,
he should so inform the Courts. Either way we cannot agree to brief him. It would be embarrassing if it became known that his evidence was based on indirect recollection prompted by a
