receive an appropriate Ministerial reply. They will also consider separately whether a "dear colleague" letter might help to head off further correspondence. Osman is seeking leave to appeal to the House of Lords against refusal of his sixth application for habeas corpus and he lodged his
seventh application on 27 January. The case therefore
remains sub judice.

Home Office officials have also advised that Lord
Caithness should not allow himself to be drawn, in his letters of acknowledgement, into discussions of points of substance raised by Lord Derwent and Lord Fanshawe, both
because of sub judice considerations, and because of the risk that anything we say may furnish grounds for further habeas corpus applications. But given that Lord Derwent took a helpful line in the debate last week, Lord Caithness might like to give him more of the background orally: I attach an agreed line to take, which could also be used with
Lord Fanshawe and others.
5. I have asked separately for Mr Berman's advice on what action we should take about Cahill's publication of a number
of classified FCO telegrams.
