I note that the Thank you for your letter of 13th February 1992. hearing of your client's application for Habeas Corpus will be I have been instructed on heard on 24th and 25th February next. behalf of the Foreign and Commonwealth Office and it is the intention of my client Department to instruct Clare Mongomery of Counsel to attend at the above mentioned hearing.
I note that at the preliminary hearing on 31st January 1992, Lord Justice Woolf requested that the nine FCO documents should be available in the Court should the Court be satisfied that your client's application did not constitute an abuse of process.
I would point out that the nine documents previously disclosed were disclosed in error a matter of which you are no doubt aware. The reason for the Foreign and Commonwealth office applying to be set of joined as party to the fourth Habeas Corpus proceedings was to
In the current interest immunity. protect public proceedings, the same considerations do not apply and I fail to see how discovery can be ordered against a body which is not a party to proceedings. In those circumstances it would not be appropriate to consent to being joined to these proceedings.
