the objective of the BNS is to anchor key people in Hong Kong who would otherwise emigrate. Those occupations which suffer from emigration heavily should be given proportionally larger shares of the quota and vice versa. To do otherwise would prejudice against those professions which had suffered from high levels of emigration and would go against the purpose of the Scheme;

it would be unfair to members of an OG if they were penalised on account of the failure of other members of their profession to put in a sufficient number of applications in the first phase;

it would not be realistic to assume that the same pattern of demand for places will be repeated in the second phase;

it would be difficult to justify the extent to which the quota should be determined by application rate; and

the answer to the problem of under-subscription, which is unlikely to arise in view of the relatively small number of places available in the second phase, would be to allow unused quotas to be transferred to other OGs and classes.

It is recommended that emigration statistics for the period of 3 years preceding the common date should continue to be the sole determinant in allocating quotas for individual OGS and AOs in the GOC in the second phase. Annex 2 gives a rough estimate of the likely size of their quotas which will result.
