Applicants suitable for transfer to OG 1

The GOC & SC Task Group considers that 169 of the applicants do not meet the existing selection guidelines for the EC, but are suitable for transfer to OG1 of the general occupations class on account of the nature of their duties as managers or administrators as described in the relevant Reference Manual.

Under Article 6 of the British Nationality (Hong Kong) (Selection Scheme) Order 1990, the Governor may transfer an application from one class to another if it appears to him that it is more appropriate to deal with it in that class. The authority to transfer applications between classes under Article 6 has been delegated to the Secretary for Security and the Director of Immigration. The procedures for transfer of suitable EC applicants to OG1 of the GOC have already been endorsed by members in April 1991 in considering SC Paper 9/91. (An extract is at Annex 2.) Accordingly, it is recommended that these 169 applications be dealt with under OG1. This number, however, will be reduced to 144 if members accept the recommendation to revise the selection guidelines as set out in SC Paper No. 42/92. Subject to members' endorsement, points will be allocated to the applicants in accordance with the criteria for OG 1, and the schedule of their interviews will be arranged according to their ranking positions in that group.

Applicants neither qualified under EC nor OG 1

There are 34 applicants who fall short of the selection guidelines for the EC, and are considered by the Task Group on GOC & Scheme Co-ordination as unsuitable for transfer to OG1 because of their lack of experience as managers or administrators. It is recommended that their applications should be submitted to the Governor with the recommendation that they should be rejected.
