In response to an enquiry, Mr Kwok said that so far a total of 18 requests had been received and none of them were appeals against the Governor's decision on the determination of voluntary agencies or British undertakings. Mr Wingfield clarified the legal position of the matter and said that there was no provision for appeals against any decision made by the Governor or the Secretary of State in the exercise of a discretion under the 1990 Act. The special inter-departmental group was set up only for administrative purposes to ensure that each of the cases brought to its attention had been properly assessed.

As regards the power of the Commissioner for Administrative Complaints, Mr Ng said that the Commissioner would only deal with administrative and procedural matters as far as the British Nationality Scheme was concerned, i.e. complaints against the conduct of the Immigration Department in processing applications; he would have no authority to challenge the Governor's discretions exercised under the Act.
