SECOND TRANCHE ARRANGEMENTS
With reference to my note of 4 December I have now clarified Hong Kong's intention with regard to the BDTC cut off date which I mentioned in paragraphs 12 and 13. I confused it with the BDTC cut off date which will appear in the other Order in Council.
For second tranche purposes applicants would not need to be BDTCs by the cut off date. They would simply need to have applied.
Under the first tranche applicants had to be BDTC or to have applied for BDTC
BDTC status before the passing of the British Nationality (Hong Kong) Act 1990. Paragraph 4(2) of Schedule 1 of that Act provides that directions by the Secretary of State under section 1(3) may include provisions for another date to be set for this purpose later than the passing of the Act. Hong Kong intend to link this new cut-off date to the passage of the new Order in Council. It would be promulgated formally by the Secretary of State's direction under section 1(3) on the second phase of the Scheme but would be publicised in Hong Kong in advance.
