SECOND TRANCHE MODIFICATIONS

I undertook to let you have a note on the changes which Hong Kong

would like to make to the British Nationality Selection Scheme

arrangements. Some of the changes would need to be brought about

by an Order in Council amending the 1990 Order. Others would be

brought about by administrative action. I deal with the former

first.

A. Amendments to Order in Council

2. Essentially Hong Kong wish to correct some of the problems

of under-subscription or under-representation which have occurred

in the first tranche amongst certain groups in the General

Occupational Class (GOC) and Disciplined Service Class (DSC), by bringing supply more closely into line with demand. They do not

wish to over-provide places amongst occupations where demand has

been lacking but rather to be able to transfer places to areas

where they will be used. It was not envisaged when the first

Order was made that any further legislative changes would be

necessary, but that was because there was no expectation of

under-subscription or of the need for transfer of places.

The under-subscription has occurred amongst private sector "managers and administrators" (one of the groups in the GOC) by

about 3,800 places, and the police (one of the groups in the DSC) by some 34 places. Hong Kong believe that since the 1990 Order sets out specific quotas for the four classes (GOC, DSC, Entrepreneurs Class (EC) and Sensitive Service Class (SSC)) they
