ii) in order to frame the new legislation in time for commencement on 4 January 1994, Hong Kong will need to review their priorities in early 1993, (only three years after they were originally defined). Patterns of emigration and hence priorities changed again by 1995.

But i) is not an insurmountable argument. There will never be enough places to cater for all key personnel, some will inevitably lose out. The priority should be to to cater for people moving into sensitive positions closer to 1997. The Governor already has discretion under the BNHKA to issue invitations to people in the Sensitive Service Class after 1994, and the Home Office draft seeks confirmation that this is what HKG intend to do. Similarly ii) is not crucial; because of the small number of places available, the choice of which year to review priorities is unlikely to have a major effect upon the overall impact of the scheme.
