5. I think Title II in fact has a somewhat limited scope. It gives no basis for a UDHK dominated LEGCO or HKG to make a unilateral declaration of independence or to set up a political entity on different lines from those in the Basic Law. Title II is simply setting out how Hong Kong will be treated in United States law after 1997 with regard to immigration matters, US laws applying to Hong Kong, US obligations applying to Hong Kong including treaties entered into by the United States and Hong Kong before 1 July 1997, rights of the Hong Kong Government and Hong Kong residents over property held in the United States, and the capacity of Hong Kong to sue and be sued in the United States courts. In conclusion, while I can see that from a political point of view, Title II may cause political problems with the Chinese, I think it is positively helpful from a legal point of view in that it provides reassurance to Hong Kong people about the position of Hong Kong and Hong Kong people after 1997 in US law.

I have not had time to check through the comments of the Hong Kong Government on the Bill but they look sensible.
