I refer to the Agreement between the Government of
Malaysia and the Government of
the Government of Hong Kong for the
surrender of fugitive offenders signed at

During the negotiations leading to the Agreement,
the I described my Government's current policy towards
death penalty and undertook to set down in writing how

the event that my Government intends
Malaysia seeks the surrender of a fugitive offender who
is punishable under the laws of Malaysia with

penalty.
Whenever the surrender of a person is sought from
Hong Kong by the Government of Malaysia in respect of an
offence which carries the death penalty, the Hong Kong
