AGREEMENT BETWEEN THE GOVERNMENT OF HONG KONG AND THE

GOVERNMENT OF THE KINGDOM OF THE NETHERLANDS FOR THE

SURRENDER OF FUGITIVE OFFENDERS

Comparison of the English and Dutch texts

THE POINTS RAISED BY PHILIP CHAN of Security Branch,

Government Secretariat, Hong Kong, in his letter of 12 June

1992 to Mr R Bunten of Hong Kong Department, FCO, are

answered below:

(a) The punctuation mark at the end of the first preambular

paragraph has now been altered from ";" to "," in the

Dutch text.

(b) The third preambular paragraph of the Dutch text does

now read "Recalling the rights conferred on every person

involved in criminal proceedings in accordance with

generally recognized standards;" ("Herinnerend aan de

rechten die aan een ieder die is betrokken in een

strafrechtelijke procedure toekomen overeenkomstig

algemeen erkende normen;").

(c) In Article 2(1)(ix) of the Dutch text the word used is

indeed "narcotic" ("verdovende").

(d) It had been agreed that "law" should be replaced by

"treaties" in Article 7(c). If "treaties" is being used

in a generic sense, then the Dutch replacement term, "overeenkomsten", is acceptable. If "treaties" is being

used in its narrower sense to denote agreements of a

rather high level, however, then "verdragen" (which

appears to have been used in an earlier Dutch draft)

might be more appropriate.

(e) In the Dutch text, the word used at line 3 of Article

9(1) is indeed "requesting" ("verzoekende").
