Article 16(2) is almost identical to Article 13(3) of the Model Agreement. Article 16 (3) is inserted at the request

of Canada.

ARTICLE 17

Article 17(1) is substantively the same as Article 14 of the Model Agreement. Sub-paragraph (b) has been amended at Canadian request to include a 'consent element'.

Article 17 (2) is inserted to ensure that the requested Party can properly consider whether consent should be given.

ARTICLE 18

This is inserted at the request of Canada. The Canadian side explained that all their recent Agreements included such a provision.

ARTICLE 19

This new Article is inserted at Canadian request to facilitate the transportation of fugitive offenders throught the jurisdiction of one of the Parties.

ARTICLE 20

33.

This follows Article 16 of the Model Agreement. Article 20(2) makes it clear that the provisions of the Agreement will be effective after its entry into force regardless of the date of the commission of the offence set out in the request.

34.

Article 20 (3) adopts a Canadian request that provision be made for suspension of the Agreement.

35.

The order in which the languages are listed is alphabetical in accordance with treaty practice.
