The legal arrangements for the surrender of fugitive

offenders involve not only agreements with other jurisdictions but

also legislation which gives officials and courts in Hong Kong the

necessary powers to implement those agreements. At present, those

powers are contained in the following United Kingdom enactments

(a) In respect of Non-Commonwealth Countries

The Schedule to the Extradition Act 1989, which

substantially reproduced the Extradition Act 1870, in

respect of countries with which the United Kingdom had a

bilateral agreement or which were party to a multilateral

agreement to which the UK was a party before 27 September

1989 (the date of commencement of the 1989 Act) if the

agreement was applied to Hong Kong;

The Extradition Act 1989, in respect of countries

with which the United Kingdom enters into a bilateral

agreement or which are parties to a multilateral agreement

to which the UK is a party after 27 September 1989 if that

agreement is applied to Hong Kong.

Order in Council 1877 directing that the Extradition

(Hong Kong) Ordinance (Cap. 236) should have effect as if

it were part of the Extradition Act 1870;

Orders in Council 1923 and 1934 directing that the

Extradition Act 1870 should apply in respect of White

Slave Traffic.
