that the continued application to the Hong Kong SAR after

30 June 1997 of multilateral agreements to which the United Kingdom is a party and which apply to Hong Kong is

a matter for discussion between the two sides in the JLG

sub-group on International Rights and Obligations;

that after 30 June 1997 a request from a jurisdiction outside the Hong Kong SAR would not be entertained solely

on the basis that the territory over which the jurisdiction extends is a member of the Commonwealth.

(a)

Matters relevant to the agreed principles for consultation

The proposed legislation will not confer on an authority in Hong Kong powers formerly held by an authority in the United Kingdom, since all relevant powers are already

conferred on the Governor.

(b)

The legislation will contain an extraterritorial element in that the crime for which a person may be surrendered will normally be a crime committed outside Hong Kong and may be a crime committed outside the jurisdiction of the party making the request. This is a necessary part of the established international regime for the surrender of fugitive offenders and accords with the normal practice and usage of the international community.

(c)

The legislation will implement various international agreements which apply to Hong Kong or which in future

will apply to the Hong Kong SAR.
