(a)
there is in place an existing bilateral agreement between the United Kingdom and that jurisdiction which applies to
Hong Kong;
(b)
there is in place a new bilateral agreement between Hong
Kong and the jurisdiction;
(c)
that jurisdiction is a party to a multilateral agreement
to which the United Kingdom is a party, which has been
applied to Hong Kong, and which provides for the surrender
of fugitive offenders; or
(d) the territory over which the jurisdiction extends is a
member of the Commonwealth.
In respect of the various categories of jurisdiction
ed in paragraph 5, the British side acknowledges respectively
(a)
that any bilateral agreements on the surrender of fugitive
offenders made between the United Kingdom and a
jurisdiction outside Hong Kong and applied to Hong Kong
will cease to apply on 1 July 1997 unless replaced by an
agreement between Hong Kong and that jurisdiction;
(b)
that there will be continuing consultation with the
Chinese side, in accordance with the existing agreed
procedures, on the making of new bilateral agreements;
