The purpose of this letter is to seek your advice on whether or not it will be necessary to localise the United Nations Act 1946 with its corresponding Orders

in Council.

As you know work is going on here on localising laws of the United Kingdom Parliament which apply to Hong Kong by Orders in Council. The legislation is being made selfstanding Hong Kong legislation which can continue beyond 1997. Guidelines have been agreed with the Chinese side on the degree of consultation to take place with them in order that such legislation can continue beyond

1997.

As you know the United Nations Act 1946 enables effect to be given to certain provisions of the Charter of the United Nations especially measures to apply sanctions.

The 1946 Act enables Orders in

in Council to be made to apply the provisions of that Act to territories including Hong Kong.

The recent set of sanctions against Iraq and now those against Libya imposed by the United Nations and enforced in Hong Kong through the machinery of the 1946 Act have caused the question to be raised to me whether the 1946 Act should be localised so that sanctions of the United Nations can be directly applied in Hong Kong without the machinery of the 1946 Act.
