At a meeting in Cabinet Office last week, it was suggested that work should be undertaken now to draft the Hong Kong (Appeals) Bill so that we would be a position to move quickly on the UK legislation should a window of opportunity arise for legislation in Hong Kong.
2. I should therefore be grateful if you would prepare drafting instructions. As I see it, these would need to i) remove the right to appeals to the Privy Council and ii) deal with any transitional arrangements for cases in the pipeline if this was necessary.
We intend that the UK legislation should be enacted only after the legislation establishing the CFA had been passed in Hong Kong.
