Problem
1.
The Hong Kong Government (HKG) wishes to present to ExCo an Amendment Bill to the Societies Ordinance to bring it into line with the Bill of Rights (BOR). This is certain to provoke Chinese objections.
Recommendation
How to proceed?
2. I recommend that we should agree to HKG consulting ExCo on the proposal to amend the Ordinance, but that we should also put to them a number of difficulties which our Legal Adviser has identified in what Hong Kong propose. I
submit a draft telegram.
Background and Argument
3.
The Societies Ordinance is one of the six Ordinances subject to the "freeze period" provided for in BOR. Amendments to this Ordinance need to be made before 8 June to ensure compliance with the BOR. HKG wish to submit the Amendment Bill to ExCo in March, and to inform the Chinese in low-key of the proposed amendments as soon as possible
