The Embassy of the Federal Republic of Germany presents its compliments to the Foreign and Commonwealth Office and referring to the International Convention for the Prevention of Pollution from Ships has the honour to bring to the attention of the Foreign and Commonwealth Office the following details.
On 12 December 1990 the 32.015 GRT United Kingdom registered MV "TRAMCO AMITY" was checked regarding the compliance with the above convention. The result of the inspection confirmed the suspicion that bilgewater containing oily residues as well as sludge was discharged outside German territoral waters direct into the sea.
The proceedings against the Master of the vessel and the Chief Engineer owing to the suspected violation of Regulation 9 Annex I of the International Convention for the Prevention of Pollution from Ships (MARPOL) have been dismissed. German authorities have no jurisdiction in this case. However, the German authorities deem prosecution necessary for the offences committed by both the Master and the Chief Engineer of the vessel.
Enclosed are documents with the details of the investigation by the German authorities.
According to Resolution A.391 (X) the International Maritime Organization will receive notice of the facts ascertained.
Please note that the Master of the vessel and the Chief Engineer have been fined already for not keeping Oil Record Book entries in an orderly manner.
The Embassy would appreciate it if the Foreign and Commonwealth Office could inform it of the action taken in this matter in due course.
