According to the provisions of the Letters Patent,
the LegCo could only be regarded as the Governor s consultative body since it did not enjoy any real power.

The Leong Che-hung model, which advocates the
setting up of standing committees to work side by side
policy branches in policy formulation, was a departure from
the present executive-oriented system and LegCo was trying
to usurp the power of the executive by trying to bring the
OMELCO panels under the umbrella of the LegCo so that the
LegCo would become part of the policy making machinery. Leong's model, if implemented, would be inconsistent with
the Letters Patent and the Royal Instructions. Hoped that
any changes to the LegCo committee system should be
consistent with the provisions of the Basic Law.

The question of whether the LegCo members elected
in 1995 could take a through-train would depend on whether
they would be elected strictly in accordance with the BL
provisions. BL provided that â Preparatory Committee
composing of mainland members and of HK members (not less
than 50% of its membership) would be established. The
Committee would be responsible for prescribing the specific
method for electing the first "Legislative Assembly" of the
HKSAR (the name of Legco should be changed to "Legislative Assembly" in 1997). The Legislative Assembly should be
composed of 60 members, with 20 by geographical through direct elections, 10 by an election
committee and
functional constituencies. If the
