MOVEMENT OF DOCUMENTS BETWEEN BTC HONG KONG AND ATTC TAIPEI
NR
1. I refer to ISD(S), Mr Paget's minute of 15 April, in which he referred to para 2 of BTC Hong Kong's telno 108 and the transmission of classified material to the Anglo-Taiwan Trade Committee in Taipei.
2. I am of the opinion that a bag despatched from or to Hong Kong would be diplomatic mail while in Hong Kong and that it is up to the Taiwanese authorities how they regard it (and a courier) whilst in their territory. Certainly the ATTC is not a diplomatic mission, but if the Taiwanese authorities are prepared to treat a bag as inviolable (outside the provisions of the VCDR or VCCR) then, to that extent, it will have protection. Our Legal Adviser agrees with this opinion.
