5. The courts of the Macao SAR shall exercise judicial independently and only follow the laws, free from ery
erference.
Article 86. The Basic Court, the Middle Level Court and the Court of Final Appeal shall be established in the Macao SAR.
The power of final adjudication in the Macao SAR shall be vested in the Court of Final Appeal of the region.
The structure, powers, functions and operations of the courts of the Macao SAR shall be prescribed by law.
Article 87. The Basic Court of the Macao SAR shall establish some special tribunals according to needs.
The original Criminal Tribunal shall be maintained.
Article 88. The Administrative Adjudication Council shall be established in the Macao SAR. The Administrative Adjudication Council is a law court for handling administrative proceedings and taxation proceedings. Those who are opposed to the decisions of the Administrative Adjudication Council may appeal to the Middle Level Court.
Article 89. Judges of the courts of the Macao SAR shall be appointed by the Chief Executive on the recommendation of an independent commission composed of local judges, lawyers and eminent persons. The selection and appointment of judges shall be based on the criteria of professional qualification; and judges of foreign nationalities can also be appointed.
A judge may only be removed for inability to discharge his or her duties or for behaviour incommensurate with his or her position by the Chief Executive on the recommendation of a tribunal appointed by the president of the Court of Final Appeal, consisting of not fewer than three local judges.
A judge of the Court of Final Appeal may only be removed by the Chief Executive on the recommendation of a panel composed of members of the Legislative Council of the Macao SAR.
The appointment and removal of judges of the Court of Final Appeal shall be reported to the NPC Standing Committee for the record.
Article 90. Presidents of the courts of the Macao SAR at various levels shall be selected from among the judges and appointed by the Chief Executive.
The president of the Court of Final Appeal shall be a Chinese citizen who is a permanent resident of the Macao SAR.
The appointment and removal of the president of the Court of Final Appeal shall be reported to the NPC Standing Committee for the record.
Article 91. Judges of the Macao SAR shall perform their judicial duties according to laws without taking any order or instruction, with the exception of the rules over appeals laid down by the court at the upper level and things subject to the stipulations in Article 19, Section (3), of this law.
Judges shall be immune from bearing any blame for their legal adjudications unless as prescribed by law,
During the term of office, a judge must not concurrently assume a position in any public or private institution and must not assume any position in a political organization.
Artide 92. The Macao SAR Frecuraturate shall indapen tently perform prosecuting function as prescribed by law, free
from any interference.
The chief procurator of the Macao SAR will be a Chinese citizen who is a permanent resident of the region and will be appointed by the central people's government on the recommendation of the Chief Executive.
The structure, powers, functions and operations will be prescribed by law.
Article 93. The original system of appointing and dismissing the assistant personnel of the judiciary in Macao will be maintained.
Article 94. On the basis of the system previously operating in Macao, the Macao SAR government may make provisions for local lawyers and lawyers from outside Macao to work and practice in the region.
Article 95. The Macao SAR may, through consultation and in accordance with law, maintain juridical relations with the judicial bodies of other parts of the country and they may render assistance to each other.
Article 96. With the assistance and authorization of the central people's government, the Macao SAR may make appropriate arrangements with foreign states for reciprocal juridical assistance.
Section 5: District Organizations.
Article 97. District organizations, which are not local bodies of political power, may be established in the Macao SAR to provide residents with services in the aspects of culture, recreation and public sanitation with the authorization of the government and to be consulted by the government on such affairs.
Article 98. The powers, functions and composition of district organizations will be proscribed by law.
Section 6: Public Servants
Article 99. Public servants serving in all government departments of the Macao SAR must be permanent residents of the region, except where otherwise provided for in Articles 100 and 101 of this law and except for certain professional and technical personnel and junior public servants employed by the Macao SAR government.
Article 100. Public servants serving in all Macao government departments, including police and assistant judicial personnel in the original judicial bodies in Macao, before the establishment of the Macao SAR may all remain in employment, continue their work and retain their seniority with pay, allowances and benefits no less favorable than before.
The Macao SAR government will pay public servants who retire after establishment of the Macao SAR, or their dependents, all pensions or maintenances due to them on terms no less favourable than before, irrespective of their nationality or place of residence.
