DRAFT DECLARATION

FOR INCLUSION IN THE COUNCIL MINUTES

COMMISSION DECLARATION ON THE CANADA CLAUSE

"The Commission considers it Inappropriate to include in a cooperation agreement between the Community and a third country a provision which refers to the respective areas of responsibility of the Community and the Member States. These are an internal Community issue.

The Commission would moreover point out that no Member State concluding an economic cooperation agreement includes in it a clause specifying, for example, that the agreement in question should not affect the Community's qualification to engage in cooperation activities and conclude Community cooperation agreements with that same third country.
